Civil Rights/1983 Litigation
M&A litigation attorneys, Sean Modjarrad and Bernard Grant, have filed a federal civil rights lawsuit against a local municipality in the Federal District Court for the Northern District of Texas on behalf of their client who was convicted for aggravated rape crime and subsequently, after serving more than 13 years in prison, exonerated based on DNA evidence. The lawsuit contends that the city and its officer violated the innocent man’s constitutional rights while investigating the offense, resulting in an erroneous conviction against him, subsequent wrongful imprisonment, loss of freedom and continued stigma (his name still showed up as a sex offender at the time the suit was initiated). Some of the causes of actions that M&A litigation attorneys have brought against the city and its officer are pursuant to the First, Fourth, and Fourteenth Amendments to the Constitution of the United States and under the Civil Rights Act, Title 42 of the United States Code, Section 1983.
